The researcher takes the problem of dispossession of the individual ownerships for the public interest in Sharia and the procedural lows.

The research points out that when the Islamic low (Sharia) has decided the dispossession for the public interest it stated as a condition just compensation for the individuals .

The research resulted in pointing out gaps in the lows applied in the dispossession of the ownership in return for a just compensations .

Accordingly the researcher recommends amendments of the procedural lows to correspond with Sharia to ensure just compensations for the individuals.
