لقد عدت الشبكات الاجتماعية الإلكترونية، وسيلة مفضلة للعديد من النشاطات الإجرامية، التي تمس الآمن العام، مستفيدة من فعالية تلك الشبكات و المواقع الإلكترونية في الاتصال و من طابعها الجماهيري، بغرض توسيع دائرة الاستهداف، و زيادة قوة التأثير.
و من أكثر المخاطر الأمنية التي يمكن أن نتطوي عليها الشبكات الاجتماعية الإلكترونية، هو استغلالها من طرف الجماعات الإجرامية، كمنصة نشاط و دعم لهم، بالإضافة لاستغلالها من قبل أطراف معادية، للتلاعب بالجماهير، في إطار ما يسمى بالقوة الناعمة.
و لا شك في أن حماية الأمن العام من المخاطر الإلكترونية التي تهدده، أمر يقتضي أخذه بعين الاعتبار، و نقصد بذلك المخاطر التي يعود مصدرها إلى الإنسان فقط، عندما يستعمل الحاسب الآلي أو شبكة الإنترنت، أو الوسائل التقنية و الرقمية الحديثة.
و يهدف البحث إلى عدة أهداف، منها : - تسليط الضوء على أهمية تدبير المراقبة الإلكترونية لسلطات الضبط الإداري العام، على كافة مواقع و شبكات التواصل الإجتماعي، للحفاظ على الأمن العام.
- معرفة آراء الفقهاء و موقف القضاء من تدبير المراقبة الإلكترونية على الخصوصية الشخصية.
- وضع استراتيجية تشريعية لتواكب التطورات التقنية و الرقمية الحديثة لحفظ الأمن العام.
و تتطلب الدراسة التحليلية استخدام المنهج الوصفي التحليلي، الذي يحاول وصف الحالة موضوع البحث، و التقصي عن بياناتها و مكوناتها و العلاقة بينهما، و الآراء التي تطرح حولها.
فالأسلوب التحليلي يقودنا إلى طريق جمع المعلومات و البيانات عن الحالة محل البحث، لتحديد كافة الجوانب المحيطة بها، و البحث و التقصي في القوانين و التشريعات المقارنة، لمعرفة مدى تطرقهم إل معالجة الحالة محل البحث.
قد انتهى البحث إلى نتائج في غاية الأهمية، تتمثل في أهمية تدبير الرقابة الإلكترونية على مواقع التواصل الاجتماعي، و شرعية استخدام كافة البرامج و التطبيقات التي تساعد في تنفيذها.
و قد أدى ذلك إلى الحد من انتشار الشائعات المغرضة و المغلوطة للحفاظ على النظام العام.
Abstract EN
Being efficient in communication, more influential and public, social networks have become a preferred means for perpetrating a host of criminal acts affecting public security.
Use of social networks by criminal groups as a platform for their activities, and by opposing parties for the manipulation of the public as a soft power, are the most common associated security risks.
Safeguarding public security against electronic threats should undoubtedly be taken into consideration; by threats here, we mean those posed by humans as a result of using computers, internet or other modern digital and technical means.
The following are the research objectives: Stress the importance of public administrative control authorities’ electronic surveillance over social media to maintain public security.
Identify jurists’ opinions as well as judicial position on electronic control over personal privacy.
Develop a legislative strategy to keep pace with modern technical and digital advancement, with a view to maintaining public security.
Descriptive, analytical method was used through which the topic was handled, and relevant data, components, their correlation and views on them were examined.
Through the use of such method, data and information on the case in question can be collected to determine all relevant aspects.
In addition, laws and comparative legislation can be examined to find out how they addressed the case.
Research concluded with crucial findings: the importance of electronic control over social media sites, and the legality of using all software and applications required for that end; this has maintained public security by curtailing the spread of false, malicious rumors.
