Abstract EN

The idea of this research is based on establishing the restriction of permissibility, devising its controls, and distinguishing it from the prohibition of permissible law.

Its practical part, however, deals with the issue of determining the UAE law for the most of dowry in the marriage contract.

It discloses its rationale and the extent of its commitment to the restrictions of permissibility established by fundamentalist scholars.

The study includes four sections: the first deals with the permissible: its truth and its relationship to the provisions of legal obligation and Sharia, while the second draws on the restriction of permissibility.

The third section tackles the controls of restricting permissibility, whereas the fourth section explores the restriction of the most of dowry.

The results of this study include: (1) the restriction of permissibility is not widely open without controls, and these controls are summarized by observing the rule of permissibility and its nature when restricted, in addition to considering the purposes, fate and exemption; (2) the UAE law does not deviate from the fundamentalist rules of restricting permissibility in determining the most of dowry, as it takes into account Sharia purposes that bring interests and drive corruption away.
