Abstract EN

The study sheds light on one of the principles of Fiqh, namely the limitation of the absolute with unspecific public interest and contemporary applications.

In this study, I have addressed the fundamentalists' point of views on the issue, and have described the cause of disagreement among scholars, in addition to bringing to light the prevailing view.

I have divided the study into an introduction, three sections and a conclusion.

In the first section, I have addressed the scientific definitions related to the subject of the research, while in the second section I have discussed the fundamentalists` statements on the limitation of the absolute with unspecific public interest and its conditions, along with illustrative examples.

In the third section, I have talked about two contemporary applications, and in the conclusion, I have stated the research result, namely that the limitation of the absolute with unspecific public interest has two primary conditions.

To this is added the consideration of interest, which can be summarized in the following: the Islamic legal text shall be stated as the acceptance of limitation and the final realization of unspecific public interest upon the limitation of the absolute.
