Abstract EN

This research is an attempt to reveal the status of the marriage contract in Shari'a and law.

It aims to prove that it is essentially a contract of honor, although some of its procedures and provision details are in some respects similar to compensation contracts.

This requires dealing with it in a completely different way from what is agreed upon in some books of jurisprudence and law.

There is no doubt that the remarkable change in all aspects of human life and the tremendous progress in various fields obliges us to deal with this subject in order to achieve the greatest goal of public and private legislation.

The purpose of embarking on this topic is also to achieve the inclusiveness and immortality of Islamic law, which is valid for all time and place.
