Abstract EN

This research paper aims to highlight the causes of flaws in the conceptualization of issues and its impact on the disruption in fatwa.

These causes include: refraining from asking experts, separating between the universal and particular conceptualization of complicated issues, clinging to annexations and direct consequences, and missing the emergency changes in the contemporary issues.

One of the results of this research is that: most of flaws in Fatwa are attributed to a confused understanding of the realistic aspect of issues.

As a result, the flaw of conception leads to fault of application of Islamic Law in terms of reality and description.

The approach adopted in this research paper is based on extrapolation of the subject’s particular details in its conceptual aspect related to the causes, as well as its practical aspect in relation to fatwa.

It also relied on interpretative and critical analysis.
