Abstract EN

The trademark is considered as the identification identity of the good or service provided by traders in the commercial market, and this identity consists of everything that can be considered as a means of communication or understanding with the consumer, without regard to the nature of its composition, whether it is visible or invisible, such as audio or by smell or taste.Traditionally, visual signs constitute the elements that make up the brand, such as graphics, letters, and others that are perceived by the sense of sight, as they constitute a common element for all consumer goods and services in the market.

In recent times, commercial life, especially in Western countries (American and European), has witnessed a clear development in the concept of the brand, to show us a new type consisting of elements other than traditional elements, such as sound, smell and taste, to have these invisible brand elements.

This research sheds light on this new type of trademark in terms of definition and types, the elements that make up this mark and the last conditions that must be met by these elements in order to be considered a trademark in the legal form.
