Abstract EN

The negative administrative decision is one of the most important decisions that are supposed to receive the attention of both jurisprudence and legislation alike because the negative decision is an illegal administrative decision that exists whenever there is silence and reluctance on the part of the administration to disclose its will in front of the requests of individuals submitted to it.

The existence of such abstinence is a matter that, as a natural result, harms the interests and rights of individuals.

Therefore, what is customary in legislation in general is the existence of administrative and judicial oversight.

The first is done through the administration’s control over itself automatically or through a grievance submitted by the person to whom the decision is addressed.

The second is done by claiming the right of individuals through the judiciary by filing the so-called administrative lawsuit (the annulment lawsuit)
