Abstract EN

This research discusses the Islamic jurisprudential method of Abu Sulaiman Muhammad Ibn cAmir Ibn Rashid al-cAdaw? al-MacwalT (Ibn cAriq), the Omani Ibadi jurist and judge, through his book "Al-Muhadhab wa cayn al-adab".

The author, an acknowledged expert in the field, discusses the issues of the Islamic legal rules of inheri-tance.

The book is distinguished by its comprehensiveness, as it incorporates the jurisprudential controversy in disputed cases and goes beyond the Ibadi school in its consideration of other schools.

The characteristics of its jurisprudential methodology can be named as follows: 1.

The deduction from the legal sources, starting from the Qur'an, Sunna, Ijmac and Qiyas, and the other evidences, namely Istihsan, cllrf, Qawl al- sahabT, Sadd al-dhara'ic and share man qablana.

The scholar discusses the different views of the scholars of his and other legal schools and overweighs what he considers to be correct.3.

Sheikh al-MacwalT is unique in his verdict to let the drowned person inherit from those who drowned with him.

He also lets people who die during a demolition inherit from each other.

In addition, he has a unique point of view on the famous mas'ala jadhaciyya.
