Abstract EN

The history of the legislative arsenal for the preservation of historical buildings, sites and cultural property in Morocco dates back more than a century.

It started with the beginning of the French protectorate and experienced slow continuity after independence.

Decree No.

2.75.443 dated December 31, 1995, establishing and organizing museums, strengthened legislation, in the field of cultural heritage.

On the other hand, Museums Law No.

56.20 ratified by the Moroccan Parliament on February 10, 2021, can be considered the first legal text for museums in the post-establishment stage of the National Museums Foundation.

Knowing that, the ratification also included an equally important legislative text: Law No.

55.20 to change and supplement Law No.

01.09 establishing the National Museum Foundation.

In sum, Moroccan legislation on museums is few, it was unable to accompany field developments and challenges, among which are the increasing numbers of museum spaces, and the inability of official institutions for a long time to promote their inherited museums to the ranks of museum institutions that attract attention nationally and internationally.

In connection with the foregoing, in the field of cultural heritage as in others, a sovereign orientation and management philosophy are hidden behind every legislation, and every legislative text includes words/keys, perhaps in the forefront of which, in relation to Law 56.20, is the phrase “Museum of Morocco”.

In this article, based on the legislation related to the management of Moroccan museums, we ask the following questions: - Is choosing a legislative approach, first, capable of creating a new phase in the life of the Moroccan Museum? -Does the legislative text amount to a historical moment, can be considered the beginning of a new era in the history of the Moroccan Museum?
