One of the most fundamental characteristics of international arbitration is the freedom of the parties to determine the rules of law applicable to the substance of the dispute.

This principle of party autonomy is recognized and guaranteed by several international conventions of which the ICSID Convention.

However, although it is considered that the parties' autonomy is extended in this field, it does not mean that this autonomy is unlimited.

This article proposes to analyze the extent and limits of party autonomy as to the law applicable to the merits of the dispute in ICSID arbitrations.

This article will analyze the role of international law as identified and applied by ICSID tribunals and explore the limits imposed by transnational public order to the parties' freedom.

L’une des caractéristiques les plus fondamentales de l’arbitrage international est la liberté dont jouissent les parties dans la détermination des règles de droit applicables au fond du litige.

Ce principe d’autonomie de la volonté est reconnu et garanti par plusieurs conventions internationales, dont la Convention CIRDI.

Toutefois, bien que l’on considère que la volonté des parties est étendue en la matière, cela ne signifie pas pour autant qu’elle est illimitée.

Cet article se propose d’analyser l’étendue et les limites de l’autonomie des parties quant au droit applicable au fond du litige dans les arbitrages menés sous les auspices du CIRDI.

Nous tenterons d’analyser au cours de ce travail, le rôle du droit international tel qu’identifié et appliqué par les tribunaux du CIRDI, mais aussi les limites qu’impose l’ordre public transnational à la liberté des parties.
