This paper attempts to identify the most important roles and competencies of the State Council institution in comparative systems, especially the French judicial and legal system, Considering that the latter had the advantage of precedent in the emergence of this institution and in view of the influence exercised by the French Council of State on other legal systems, Which followed suit, both in terms of adopting this institution within the legal and judicial system, or from the influence it exerted on administrative jurisprudence, Then try to measure the importance of these roles and competencies in each of the judicial, administrative and legislative work and their repercussions, To be able to monitor the manifestations of the void left by the absence of this institution within the national institutional and legal system, And thus also to determine the extent of the benefit that can be achieved by announcing the establishment of the State Council within the Moroccan administrative and judicial systems.
