Foreign investment is the first goal sought by most countries because it is a major channel through which capital and practical and technical expertise flow, contributing to the acceleration of the economy and achieving the desired development.

States have therefore sought to provide legal guarantees, both at the level of legislation and international conventions on foreign investment.

Because of the latter's close association with the protection of the interests of the foreign investor, perhaps the most important guarantees are customary and agreement international law.
