The question of any ijtihād's legitimacy is the ability of predicting the judgement after being issued, and how to apply it on reality، This task is known in the Islamic juriprudence as Iʿtibār al-maʾāl.

The current research examines the following items: 1.

The fatwa and the source of Iʿtibār al-maʾāl.

The fatwa between considering the current status and the consequences: Arooting approach.

3.

The rules of applying Iʿtibār al-maʾāl.
