Considering the tourist property of the investment-oriented real estate, the legislator seeks to acquire it in order to form a real estate portfolio for tourism investment.

This is through the enactment of several legal texts to obtain them through private law as a general rule, and in case the latter fails, the means of public law, which are the expropriation for the public benefit and the right of administrative law, will be applied.

We will therefore try to highlight through this paper the administrative transparency in obtaining the tourist real estate pot as a constraint on the public interest.
