Abstract EN

This research studies the reasons for doubling the punishment in Algerian law and its cases, and aims to indicate the relationship between the circumstances of the crime and the punishments prescribed for it.

it also aims to define the meaning of doubling the punishment, explain its reasons, extract its cases from the articles of the Algerian penal code, and classify the reasons for this doubling according to specific criterions.

among the most important results of the research are that the Algerian legislator used the term “doubling” in its tightening of some punishments.

this means that the punishment in these cases, which was determined by it, is twice as the normal case.

the legislator decided that in a number of crimes, given several considerations; some crimes doubled its punishment in view at the offender's trait, some in view at the situation of the offender, and some in view at the offender's habit in committing it, or its description as a recidivism crime.
