تعرض مبدأ استقلالية المسؤولية الإدارية لأزمة حادة نتيجة تراجع القاضي الجزائري بفعل حالات الاستعارة و الاقتراب من المسؤولية المدنية، مما ساهم في تأسيس نظام قانوني مزدوج، و بغض النظر عن مسألة انتظام الأوضاع المقررة التي يراعيها في تأسيس المسؤولية على القواعد الإدارية أو المدنية أوهما معا، لابد من البحث المستمر عن الأسانيد القانونية لهذا الموقف و مدى استجابتها للنظامين القانوني و القضائي، فالنتائج تبدي صورة سيئة بسبب تنافر قواعد المسؤوليتين، كما قد تبدي أحيانا صورة إيجابية بفعل حماية ضحايا أعمال الإدارة و تسهيل عمل القضاة الإداريين، الشيء الذي يضفي خصوصية أكثر حول مفهوم استقلالية المسؤولية في القانون الإداري الجزائري
Abstract EN
The principle of autonomy of administrative responsibility was be confronted by a profound crisis, which resulted from the abandonment of the Algerian judge because states of loans and approaches to civil responsibility, which contributed to the establishment of a binary juridical regime.
Regardless of the question regularity of the prescribed positions he has respected in establishing responsibility for administrative or civil rules or both, must be constantly search the reasons and bases for this attitude and the extent of his response to the regimes; juridical and judicial.
Therefore, the results show a poor image due to the heterogeneity of the rules of responsibilities, and sometimes a positive image regarding the protection of victims of administrative activities and the simplification of the work of administrative judges, which gives more specificity on the concept of autonomy of responsibility in Algerian administrative law.

Le principe d'autonomie de la responsabilité administrative a été confrontée par une crise profonde, qui a résulté à partir de l'abandonnement du juge Algérien à cause des cas de prêts et approches de la responsabilité civile, ce qui a contribué à l'établissement d'un régime juridique binaire.
Indépendamment de la question de régularité des positions prescrites qu'il a respecté pour établir la responsabilité sur des règles administratives ou civiles ou des deux, il faudra chercher, constamment les fondements juridiques de cette attitude et l'étendue de sa réponse aux régimes; juridique et judiciaire.
Donc, les résultats montrent une mauvaise image en raison de l'hétérogénéité des règles de responsabilités, et parfois une image positive en ce qui concerne la protection des victimes des activités de l'administration et la simplification du travail des juges administratifs, ce qui donne plus de spécificité sur le concept d'autonomie de la responsabilité en droit administratif Algérien.
