Abstract EN

The Code of Money and Credit granted the Bank of Algeria wide powers in line with the necessity of its independence from government agencies.

Consequently, the Monetary and Credit Council and the Banking Committee were granted broad competencies and powers in the monetary and banking field, so that these two bodies became independent administrative authorities enjoying the privileges of public authority and broad disciplinary and repressive powers.

Which imposes the necessity of embodying the principle of administrative judicial control over these authorities and competencies in order to achieve the principle of legality and the need to protect the rights of banking and banking institutions operating in this sector.

The specificity of administrative banking disputes as economic disputes imposes the need to establish legal provisions that will strengthen the rules of credit in banking and banking and determine the nature of the relationship between the Bank of Algeria and economic dealers in the banking banking field in a way that enhances the objective and procedural guarantees granted to them in the face of the broad repressive and disciplinary powers granted to the banking agencies.

The Bank of Algeria, which embodies an effective administrative control that protects the rights and freedoms granted in the economic aspect.
