Abstract EN

This research aims to study the relationship between the analogy and derivation to determine the role and position of language in the principles of jurisprudence, and how to infer the reason through language; i have followed the inductive method then the deductive method.

the research included an introduction, two chapters, and a conclusion.

in the first search, i wrote about the meaning of derivation and analogy in language and terminology.

in the second chapter, i explained the meaning of the resonation and its paths, the relationship of derivation to paths of reasoning, and the extent of the significance of the derivation on the cause and its validity to the people of knowledge, the types of explanatory derivations, how the analogy can benefit from the derivation, the meaning of the linguistic analogy and the relationship of derivation by linguistic analogy.

at the end of the research, i reached the following results: correlation between analogies and derivation, the derivation is an important explanatory path adopted by scholars in revealing and it considered under the indication method, the derivative in terms of its indication of the cause types some of which are stronger than others, to suspend the judgment of derivative is authorized by the derivation used the suspension of the judgment with the relative with its connection feels on the effective case of the derivation principle.
