Considering that the accused is the party concerned in the first place with all the guarantees enshrined in both the Mauritanian and Tunisian Code of Criminal Procedure, he, along the chapters related to the investigation, can sometimes be a participant in the procedures and influence them, as well as he may be absent from them, according to what is required by the interest of the investigation in terms of the independence of the investigating judge.

On the one hand, and ensuring the disclosure of the truth on a third hand, which makes secrecy absent or dominate at this stage, as required by the interest of the research, whether it is towards the accused or towards the rest of the parties, according to their position in the investigation.
