Abstract EN

The study handled the applicable law in the conflict of electronic commercial contracts, the study problem raised from distant contracting makes disputes between laws of states which makes conflict of laws whenever the contract related to foreign element, the importance of the study emerged from spreading of electronic trade size which increases recently in addition to necessity to put criteria to govern and protect parties which is the applicable law on electronic trade contracts, the study targeted to identify legal scopes of electronic trade and knowing the applicable law on conflicts of electronic trade in attendance and absence of parties, the study followed descriptive, analytical and comparative approach, the study results are that parties should choose the competent law in respective disputes and in default the judge determined it impliedly.
