Abstract EN

The study of fundamental Tarjih (preponderance) is considered as one of the most significant studies in the science of Islamic jurisprudence, as it represents an important methodological tool for the Mujtahid (Interpreter) in that it enables them to identify the degrees and measure the strength of evidence and what approach to adopt when two pieces of evidence conflict or equate.

Accordingly, the interpreter draws their scientific and methodological data from all Islamic sciences.

And if our scholars, may God have mercy on them, have excelled in keeping up with and appropriately employing the foundations of their temporal space in the service of the science of the principles of Islamic Jurisprudence in general and Tarjih in particular, then we cannot deny the need for a critical and careful study of these investigations in order to remove the impurities that were attached to them for a period of time.

Added to this is the need for editing oral narratives in a number of controversial issues without neglecting to link it to the natural sciences and contemporary humanism, as one of the methodological tools to help in a better conception of the field of Sharia (Islamic law) in order to ensure the proper interpretation of the intended meanings that best fit the contextual reality
