Abstract EN

The study prescribed the penal protection of peasant real estate.

the Algerian legislature found that it had the first special penal protection for peasant land and surface property, including seedlings, crops and irrigation facilities, as reflected in the provisions of the penal code and certain special laws.

it turns out that penal protection includes peasant property in all its legal types: private, national, and “Waqf” ownership.

also the penal code articles, in particular article 386, applied on all types of property, private, national, and “Waqf”, despite the differences and questions raised by this penal code article between jurists and judges, due to different comprehension of the text in both Arabic and French.
