Since the middle of the twentieth century, Africa has experienced many coups d'état against democratically elected power, in accordance with constitutional rules, which are a clear violation of legitimacy and popular sovereignty, despite numerous attempts to condemn this phenomenon.

These unconstitutional changes have largely taken the form of military coups d'état, which were aimed at eliminating the constitutional course and seizing power through the use of force and other methods.

In the face of this critical situation, which has come to threaten regional peace and security, the African Union, since its formal establishment in 2002 and through its Charter and by-laws, has tried to combat all unconstitutional ways of gaining access to government.

This article aims to reveal the efforts of the African organization to prevent, first, the increase in the phenomenon and, second, its treatment, and to assess the effectiveness of these texts in preventing coups d'état against constitutional legitimacy, whatever the means used.
