Abstract AR
تهدف دراستنا لموضوع حماية المستهلك الإلكتروني من الشروط التعسفية في القانون الجزائري، إلى معرفة مدى كفاية الأحكام القانونية التي أقرها المشرع الجزائري سواء في القانون المدني أو في القواعد الخاصة لأجل حماية المستهلك الإلكتروني، الذي يعتبر الطرف الضعيف في العقد من الشروط التعسفية التي يدرجها المهني في العقد الإلكتروني.
وفي هذا الصدد نجد المشرع الجزائري قام بتنظيم أحكام قانونية لحمايته من تلك الشروط وذلك وفقا للقواعد العامة في القانون المدني، إلا أن هذه الأخيرة لم تكن كافية لمكافحة الشروط التعسفية، لذلك أقر المشرع آليات أخرى في قوانين خاصة بحماية المستهلك المتمثلة في التزامات المهني اتجاه المستهلك، لكن هذه القوانين لم توفر الحماية الكافية، لذلك قام المشرع باستحداث آليات أخرى المتمثلة في جمعية حماية المستهلكين ولجنة البنود التعسفية، كما أعطى للقاضي سلطة تعديل، إلغاء، تفسير الشروط التعسفية، إضافة إلى توقيع الجزاء المنصوص عليه في قانون 18-05 المتعلق بالتجارة الإلكترونية على كل من يمارس هذه الشروط
Abstract EN
Our study of the topic of electronic consumer protection against arbitrary conditions in Algerian law aims to determine the adequacy of the legal provisions approved by Algerian legislation, both in the Civil Code and in the special rules for the protection of electronic consumer, which is considered to be a vulnerable party to the contract to be one of the arbitrary conditions incorporated by the professional into the electronic contract.
In this regard, the Algerian legislature has regulated legal provisions to protect it from such conditions in accordance with the general rules of the Civil Code.
