Abstract EN

This study came to search for the authority of the President of the Republic to legislate by orders in light of the constitutional amendment of the year 2020, whether it was in normal circumstances related to the ence of Parliament, or under the exceptional situation, given that Article 142 of it restricted the olute right of legislation in this case only without addressing the states of emergency and siege.

Nor to a state of war, because in the latter the work of the constitution is disrupted.

It also restricted the authority of the president with a number of controls to exercise this right, in order to guarantee the rights and freedoms of individuals on the one hand, and on the other hand, limiting the dominance of the president's authority over the legislative process.

The updated amendment regarding the mechanism of legislation by order was also highlighted by subjecting it to the oversight of the Constitutional Court.
