The criminal protection enjoyed by public officials and those who are in their position does not stop at the state decided for them by the provisions of the penal laws only, but extends to include what is decided for them by the provisions of the penal procedures as well.

The provisions are objective and the second is procedural.

If substantive protection derives its elements from the rules of criminalization and punishment, then the procedural protection derives its elements from the rules of criminal procedures, that is, the rules taken from organizing the protectors of the judiciary and its competencies, detecting crimes and verifying their occurrence, arresting the perpetrators, investigating and prosecuting them as its subject matter.
