The circle of activities of the legal person has considerably expanded today, as production, distribution and sale operations are no longer on the hands of the natural person, but on those of huge companies whose mission is to make profit by all means, including trading in Cheated foodstuffs, harming the consumer health.

Thus, it was necessary to establish the criminal liability of the legal person which was the subject of great jurisprudential controversy between supporters and opponents.

However, our national legislation did not take into account the criminal liability of the legal person and did not exclude it from many of legal texts, until the amendment of the Criminal Code in 2004, which stipulated the criminal liability of the legal person in the event of cheating in foodstuffs by providing certain conditions followed by punitive sanctions.
