Abstract EN

The Contract Management is one of the modern contracts, which emerged due to classic contracts' deficits to cover modern economics areas.

Moreover, classic contracts have not been able to adapt to the delicacy and complexity of the current economic transactions' transformations.

Hence, new formulas of transaction were drafted and imposed at the international level; thus, the Algerian legislature has adopted the "Contract Management".

This mechanism is based on the principle of separation between Public Economic Institutions' ownership and their management authority.

This principle can be dated to ancient legal thought of Western laws, which were demonstrated in The Anglo-American “Trust” system and The Roman "Fiducia” system, and which are an old version of modern public management.
