The crime of enforced disappearance is one of the crimes against humanity defined in article 7 of the statute of the international criminal court as : “any kidnapping, detention or arrest by the state or one of its agents is called enforced disappearance”.

the difference between them is necessary to set the legal term for the crime.

as well as laying down characteristics that distinguish them from other international crimes, such as the lack of amnesty and the statute of limitations, due to their importance in international criminal legislation.

in order to respect and protect human rights, the life to which the crime of enforced disappearance is subjected has made the international community cooperate to curb this crime by creating mechanisms for protection at the international and regional levels, as well as establishing an international criminal court to punish the perpetrators of these crimes within the framework of the law.
