Abstract EN

This article deals with the notion of decision to pardon the penalty, its pillars and its legal foundation in Algerian legislation, also this article aims to search the legal foundation for the annulment process in the event that there is a legal possibility to do so, and to give a perception of the legal mechanism that achieves it.

the most important conclusions obtained are that the pardon decision can be annulled if it is a defect in legitimacy, and also if it includes the possibility that it was pronounced with void conditions.
