The article reveals the nature of overtime work, the motives for resorting to it, and the rules governing it in labor legislation.

this study aims to clarify the rights established for the worker to resort to overtime work, and the mechanisms of control over this by the labor inspectorate and the judicial authorities to preserve the interest of the worker and the employer together.

the research concludes that working overtime is an exception to the legal duration of work, and when resorting to it, it is necessary to respect the conditions stipulated in labor legislation and collective agreements and enable the worker to have all the rights assigned to him.
