The traditional criminal justice system faces several challenges that have damaged its reputation among criminal law practitioners and even the public, leading to the development of criminal policy and strategies that are advance criminal justice, and perhaps the most important solution that has emerged is to adopting the principle of consent in the criminal field.

And one of the most important mechanisms of this principle is criminal mediation, because it has many positive qualities, so it is most applicable, but what needs to be studied is that it raises many contradictions and issues that can question its credibility, especially since this is a relatively modern system that is still being considered in some legislation but not in others.
