The characteristics of smart systems constitute an obstacle for civil liability to perform its compensatory function for the damages they cause.

Hence, this study was the result of legal thinking based primarily on the analytical and extrapolative approach to examining the appropriateness of liability rules for personal and third-party acts to hold the smart system accountable.

the result is that the rules are useless due to the non-recognition of the smart system as a subject of law.

in another attempt to investigate the consistency of the objective liability rules, especially the rules for guarding non-living objects and producer liability, they seemed somewhat appropriate with some obstacles.

the result is that objective liability rules can be adapted to compensate for AI damage by dealing with it flexibly and developing special texts that determine the responsibility of both the producer and the programmer and the user.
