يتناول هذا البحث حكم الغرامة المالية في الديون المتأخرة، فيعرض لأسباب الغرامة، كالإفلاس، والإعسار، ثم يعرض للتصور الفقهي لهذه القضية، مرجحا أنها صورة من صور الربا، ثم يتعرض لحكم فرض عقوبة تعزيزية من قبل الحاكم، ثم بيان التكييف الفقهي للغرامة المالية في صورها المختلفة.
Abstract EN
This research deals with the rule of a financial fine in late debts, then it presents the reasons for the financial fine such as bankruptcy and insolvency, then it presents the jurisprudential perception of this case suggesting that it is a form of usury, then it is exposed to the ruling of imposing a disciplinary punishment by the ruler, then a statement of the jurisprudential perception of the financial fine in its various forms.
