Abstract EN

This research demonstrates the jurisprudential provisions of the issue of remittances.

This issue has crucial importance in our social life in general and in the Islamic economy in particular, especially with the development of mass communications and the appearance of incorporated enterprises such banks etc.

In the light of these developments, the transactions of remittances have increased, and those transactions are not carried out between two ordinary individuals but may be between an ordinary individual and an incorporated enterprise.

Accordingly, these transactions have gone through many forms documenting the debts such checks, bills of exchange and bank transfers.

Therefore, the importance of this research has come to the ground as it studies the provisions of these transactions in the light of the provisions of debts in the Islamic Jurisprudence.

Hence, this research is keen on clarifying the concept of remittance and its rulings in the four schools of jurisprudence in accordance with the comparative approach.

The research has referred to a group of findings and recommendations.

One of those findings is that the remittance results in freedom for the transferer from the liability of debt and remittance has numerous contemporary applications that have governing rules and they must be followed.

As for the recommendations, the most important one draws attention to the need for finding legitimate alternatives to keep up with the developments in the contemporary financial transactions and they should be documented jurisprudentially in accordance with the contracts of the legitimate transactions in the Islamic jurisprudence.
