Arabic Abstract

هدفت هذه الد ا رسة إلى بيان أحكام الإنابة القضائية وفق قانون أصول المحاكمات المدنية الأردني، حيث قام الباحث ببيان مفهوم الإنابة القضائية وشروطها، وطبيعتها القانونية، إضافة إلى التمييز بين الإنابة القضائية وغيرها من الصور المشابهة لها، كما أوضح الباحث إج ا رءات إثبات وتنفيذ الإنابة القضائية، وبيان الآثار المترتبة عليها، ورغم أهمية الد ا رسة وما تلعبه الإنابة القضائية من دور هام في تسريع الإج ا رءات القضائية واختصار الوقت وزيادة أواصر التعاون القضائي بين المحاكم، إلا أن الباحث واجه صعوبة في د ا رسته، نظ ا رً لندرة الد ا رسات السابقة، أو وجود بعض الد ا رسات المتناثرة والتي لم تتطرق لموضوع بشكل مباشر ومفصل.

قد توصل الباحث إلى عدة نتائج وتوصيات، منها أن المشرع الأردني لم ينظم أحكام الإنابة القضائية في قانون أصول المحاكمات المدنية الأردني، كما أنه لم يبين حالات الإنابة القضائية، وشروطها، وتوصل الباحث إلى ضرورة إضافة نص قانوني في قانون أصول المحاكمات المدنية الأردني، يُعنى بتنظيم أحكام الإنابة القضائية وبيان شروطها والآثار المترتبة عليها، وذلك منعاً للتعارض بين نصوص قانون أصول المحاكمات المدنية الأردني، واتفاقية الرياض للتعاون القضائي.

English Abstract

This study aimed to clarify the provisions of judicial delegation according to the Jordanian Civil Procedure Code, where the researcher explained the concept of judicial delegation, its conditions, and its legal nature, in addition to distinguishing between judicial delegation and other forms similar to it.

Despite the importance of the study and the important role played by judicial representation in accelerating judicial procedures, shortening time and increasing judicial cooperation between courts, the researcher faced difficulty in studying it, due to the scarcity of previous studies, or the existence of some scattered studies that did not directly address the topic and detailed.

The researcher reached several conclusions and recommendations, including that the Jordanian legislator did not regulate the provisions of judicial delegation in the Jordanian Civil Procedure Code, nor did it indicate the cases of judicial delegation and its conditions, and the researcher reached the need to add a legal text in the Jordanian Civil Procedure Code, concerned with organizing Judicial delegation provisions and a statement of its conditions and implications, in order to prevent a conflict between the provisions of the Jordanian Civil Procedure Code and the Riyadh Agreement for Judicial Cooperation.
