Arabic Abstract

عملت هذه الدراسة بالبحث والتحليل لنصوص القائون المتعلقة والمتخصصة في الحوكمة في الشركات المساهمة العامة لبيان أهمية هذه القواعد بالحد من قضايا الفساد، واتبع الباحث في هذه الدراسة المنهج الوصفي التحليلي لنصوص القائون المتعلقة بموضوع الحوكمة.

وتوصلت هذه الدراسة إلى أن قواعد حوكمة الشركات تلعب دورا هاما في الحد من مشكلة الفساد المالي والإداري في الشركات المساهمة العامة، وذلك من خلال الآليات الداخلية لحوكمة الشركات، والتي من أهم مبادئها الإفصاح والشفافية والمسائلة والرقابة والتتظيم الإداري وهي مبادئ من شأنها الحد من أي انحرافات مالية أو إدارية، وعلى ضوء النتائج توصلت الدراسة إلى توصيات أهمها استحداث نص تشريعي في الأرين ينص على تشكيل محكمة متخصصة بمحارية جرائم الفساد، تطوير وسائل العقاب في التشريعات الأردنية في مجال مكافحة كافة صور الفساد، مع مراعاة عدم الغلو في التجريم أو العقاب.

English Abstract

This study aimed to identify the civil and administrative liability procedures for leaking protected documents on social media, criminalizing civil and administrative laws for leaking those protected documents through social media, the legal effects of leaking protected documents, and clarifying the legal texts for leaking protected documents through social media.

To reach results with a realistic effect, the researcher used the descriptive analytical method and the legal method.

Among the findings of the researcher is that the leakage of protected documents by public officials results in two forms of accountability, namely penal and disciplinary effects, and the legal basis for disciplinary effects is in the Civil Service System No.

(9) for the year 2020, and that leaking protected documents leads to an imbalance in the regularity.

The general state of the government administrative apparatus in the country that is related to influencing the public's confidence in the public office.

Based on the results of the study, the researcher recommended the development of laws related to document leakage and electronic crimes through the establishment of an electronic monitoring unit for all public and private electronic means.
