Arabic Abstract

يهدف هذا البحث إلى بيان الحقوق المادية للمسنين في الشريعة الإسلامية، وهي الحقوق المتعلقة بالاحتياجات المادية في حياتهم اليومية، وتتمثل في توفير النفقات المالية، والرعاية الصحية والخدمية، وتكمن أهمية البحث في القضية التي يناقشها، فهم الفئة الأضعف في المجتمع، وينبغي إبراز حقوقهم.

وقد سلكت في كتابته، المنهج الاستقرائي، ثم المقارن، وتوصلت من خلاله إلى العديد من النتائج، أهمها: أن الشريعة الإسلامية صاحبة السبق في حماية حقوق المسنين، باعتبارهم الفئات المستضعفة والأكثر عوزا، وحقوقهم تقع ضمن الواجبات الشرعية، ومحاطة بسياج يضمنها على مر العصور؛ لأنها جعلتها في محيط الأسرة والمجتمع، ونص الشارع عليها بنصوص لا تقبل الجدل، وتمتاز هذه الحقوق بالواقعية.

وثمرتها التآلف بين طبقات المجتمع، والعمل على منع الآفات التي تنخر فيه، وتغذي روح الانتقام، ومن ثم يسود التفاؤل والوئام والتسامح بين البشر الذين يقطنون في مجتمع واحد، وتحت مظلة واحدة.

كما أوصى من خلاله، بنشر الوعي بقضية المسنين، وعدم فصلها عن قضايا المجتمع، وتوجيه الكوادر الدعوية في المؤسسات الدينية إلى تبني هذه القضية، وتوعية المجتمع بخطورتها، ومظاهرها السلبية، ومدى خطورتها على المسنين خاصة، والمجتمعات بشكل عام.

English Abstract

This research aims to clarify the material rights of the elderly in Islamic law, which are the rights related to the material needs in their daily lives, and are represented in the provision of financial expenses, health and service care, and the importance of research lies in the issue discussed by them, they are the weakest group in society, and their rights should be highlighted.

in writing this research, i followed the inductive, then comparative, approach, and reached through it many results, the most important of which are: Islamic law is the first to protect the rights of the elderly, as they are the vulnerable and most needy group, and their rights fall within the legal duties, and are surrounded by a fence that guarantees them over time.

ages; because he placed them in the context of the family and society, and the legislator stipulated them in uncontroversial texts, and these rights are characterized by realism.

its fruit is the synthesis between the layers of society, and work to prevent the pests that gnaw at it, and nourish the spirit of revenge, and then optimism, harmony and tolerance prevail among all human beings who live in one society, and under one umbrella.

i also recommend spreading awareness of the issue of the elderly, not separating it from community issues, directing advocacy cadres in religious institutions to adopt this issue, and educating community members about its danger, its negative manifestations, and the extent of its danger to the elderly in particular, and societies in general.
