Arabic Abstract

ناقش البحث موضوع حماية حقوق المسنين في الأنظمة القانونية"، فتناول مضمون مصطلح المسن، والشيخوخة، وتحدث عن الحماية الدولية لحقوق المسنين، في المواثيق الدولية والاتفاقات والبروتوكولات، وأشار البحث إلى التكريس الدستوري لحقوق المسنين بشكل صريح أو ضمني، ومن أهمها الدستور المصري الحالي الصادر عام ٢٠١٤، كما تناول التنظيم التشريعي لحقوق المسنين في بعض الدول العربية، وتناول أيضا مشروع القانون المصري الخاص بحقوق المسنين، واستعرض البحث أنواع الحقوق المكفولة للمسنين، كالحماية الاجتماعية والرعاية الاجتماعية المتمثلة في التكاتف الأسري والرعاية المؤسسية، والرعاية المنزلية للمسن والحق في الرعاية الصحية، والحق في التأهيل المجتمعي والتمكين، والحق في ممارسة الرياضة والأنشطة الثقافية والترفيهية، والحق في المشاركة في الحياة السياسية والاجتماعية والحق في الحماية القضائية، والحق في الإعفاء.

كما أشار إلى آليات حماية حقوق المسنين التي تتمثل في الآليات المؤسسية التي تختص برعاية المسنين، وكذلك الآليات التنفيذية لحماية حقوق المسنين من خلال القواعد القانونية التي تفرض حماية واقعية لحماية ورعاية المسنين.

English Abstract

The research discussed the topic of “protecting the rights of the elderly in legal systems”, it dealt with the content of the term elderly, and old age, and the international protection of the rights of the elderly, in international conventions, agreements and protocols.

in 2014, it also dealt with the legislative regulation of the rights of the elderly in some Arab countries, and the Egyptian draft law on the rights of the elderly, and the research reviewed the types of rights guaranteed to the elderly, such as social protection, social care represented by family solidarity and institutional care, and the right to health care the right to community rehabilitation and empowerment, the right to practice sports and cultural and recreational activities, the right to judicial protection, and the right to exemption.

he also referred to the mechanisms for protecting the rights of the elderly, which are represented in the institutional mechanisms concerned with the care of the elderly, as well as the executive mechanisms for protecting the rights of the elderly.
