Wael Hallaq took a lot of interest in reviewing the researches of the orientalists in the history of Islamic jurisprudence and its domains, and he noticed that they all agreed on misprizing the Islamic Fikh due to its unoriginality and indebtedness to foreign laws.

Therefore, Hallaq's work focused on refuting the orientalist allegations as described in the works of Schacht, exposing its many epistemological flaws and its compliance with the western colonial paradigm, then concluded that the superiority complex associated with the orientalist discourse impeded the recognition of the upsides of the Islamic Fiqh, which essentially lie in relying on the ethical factor.
