Abstract EN

The legislative initiative of the Moroccan Parliamentary minorities during the ninth legislative mandate (2011-2016).

The constitutionalization of the rights of the Parliamentary minorities is one of the most important updates of the constitutional reform of the year of 2011.

Where granted it several legal powers and privileges, which would exceed the constraints of the requirements of representative democracy, which make the proportional representation base one of the most important tools for distributing rights and benefiting from the constitutional capabilities between the majority and the parliamentary minorities, which gave this latter a special status that qualifies it to actively and constructively contribute to increasing the efficiency of performing its constitutional functions, especially at the level of the legislative initiative, and making it a partner in parliamentary decision-making.

This situation requires acquaintance with the most important developments related to the constitutional reform of 2011 at the level of the legislative initiative of the parliamentary minorities, and the extent to which it invests the legal capabilities related to this function, in order to exceed the obstacles of its limited performance and advance the parliamentary work of the House of Representatives, which calls for examining its outcome during the ninth legislative term (2011-2016) as well as its evaluation.

In order to foster the pursuit the Moroccan constitutional legislator’s endeavor to move from the functional parliament to the parliament of legislative power, as well as to represent the conditions of parliamentary best practice.
