Abstract EN

This research aims to provide a theoretical, ethical, Fiqhi / Sharia and legal framing of the issue of information privacy, with regard to Qatari society’s recovery from COVID-19 pandemic, in order to achieve a balance between the private interest and the public interest.

It highlights also the extent to which the decision to compel individuals to install―Ehteraz‖ application on mobile phones is balancing between the right to privacy on one hand, and health security and the recovery of society on the other hand.

the research adopted an interdisciplinary approach that looks at the subject from three complementary angles ; the ethical, Fiqhi / Sharia, and legal angle.

accordingly, the paper relied on the inductive and analytical methods.

the study reached several results, the most important of which are ; the difficulty of defining an agreed-upon concept of privacy because the concept is subject to different cultural and social contexts.

this confirmed to us the urgent need to take into account the cultural and social aspects of societies when defining privacy and the procedures related to it.

accordingly, the presence of the Islamic sources in determining the value of privacy in the Qatari context is very important, given that Qatari society is very much adhered to its Arab and Islamic identity and culture.

the study also found that the legislative structure of the state of Qatar guarantees the principles of balancing the right to privacy and the demand for societal recovery.

this balance requires that the measure to install ehteraz application should take into account the privacy of individuals be imposed in the narrowest scope.
