الأطر التشريعية و القانونية لحماية البيانات البحثية في مصر : دراسة تحليلية

Abstract EN

The current era is witnessing an acceleration in the pace of scientific and knowledge development, which has led to a growing interest in the field of research data, as this data carries a high scientific value that contributes to achieving global excellence through the investment of data to achieve the efficiency and integrity of scientific research (al-Fahmy & al-Dhawi, 2018), and with the increasing interest of researchers in their research data, their increasing concern that this data is not preserved and managed in order to benefit from it, in the work of new research and studies that add to knowledge, and to address the problem of repetition of research data among researchers, in light of the emergence of many legislative and legal challenges with the increase paying attention to research data and using technical developments in its processing and management, especially in Arab countries, including Egypt ; therefore, this study provides an analysis of the current status of the legislative and legal frameworks for managing research data in Egypt, in light of the relevant international initiatives in this regard, through the use of the descriptive analytical approach, and the method of content analysis.

the study showed a number of results, the most important of which are : the absence of research data management practices in Egypt, and consequently concern about some of the legislative and ethical issues involved in sharing this data, which were included in the Egyptian legislative system for managing research data, such as laws : intellectual property, privacy, protection of personal data, and combating information technology crimes, and made a set of recommendations, the most important of which are : the need to increase researchers’ awareness of the importance of sharing data and benefiting from it in conducting more research in light of respecting the laws and legislation regulating the sharing and management of this data, and the need to amend some texts of the articles of the law on the protection of personal data and the protection of intellectual property rights to allow through the safe and effective exchange of research data in Egypt, and the completion of the legislative system for the protection of research data in Egypt, through the issuance of the most important laws related to its processing, which is the law of the right to information, which has not yet been issued.
