Abstract EN

This study was conducted, to show that the original lawsuit as one of the limited judicial oversights means came to protect the constitutional document by rejecting the legislation that contradicts the provisions of the constitution in accordance with the provisions of the constitution and the law of the Constitutional Court.

However, through the study, it was found that there is a legislative deficiency in the texts regulating it, the most important of which is the exclusion of the natural and legal persons segment, unions and community institutions, as well as the head of the Judicial Council from the ability to initiate the original case, being the protector of the rights and freedoms of public individuals, and since the legislator in its recent amendments did not address this matter, which led to the reduction of the concept of judicial oversight on the constitutionality of laws.

Hence, the importance of the study was manifested in clarifying the adequacy of this case in achieving the content of judicial oversight on the constitutionality of law.
