Abstract EN

The problematic approach to women's economic rights within their customarily civil and human rights is considered during french protectorate, a condition for understanding the foundations and questions of these rights.

one of the purposes of this approach is to investigate the custom 's posture on mentioned rights, which is not isolated from the tribe's position on women in various daily structures.

the custom always reflects the tribe's representations of women in their various social status which are often positive, despite the position of this system on the share of women on the land, and generally, we bet today in the public debate on women's economic rights, on some of the principles of customary legislation.

this study is important in the fact that the custom in the history of morocco has fronted some judicial dilemmas with women in general, and their diverse rights in particular, which are still unsolved, and in guiding the moroccan legislator and researchers on women's and family issues to the importance of historical and heritage studies in jurisprudence and enacting.
