This research sheds light on civil liability by dealing with the issue of default arising from personal action by showing its pillars and effects and the legal controls that govern it as being of tremendous importance at the legal level in our contemporary world.

It is imperative for the legislator to keep pace with this development by approving what has emerged in the tort liability for personal action, as the Algerian legislator has dealt with the provisions of liability for personal actions in the first section of the third chapter under the title of the act entitled to compensation from the first chapter, "sources of obligation", from the second book.
