Most of the comparative legislations, in varying degrees, have recognized the responsibility of members of the executive authority in the event that they commit some acts in violation of the law during the exercise of their governmental functions in application of the principle of legality and the rule of law.

However, it was noted that despite the activation of some of these comparative legislation on the criminal responsibility of ministers, there is a legislative shortcoming represented in the lack of sufficient texts for these legislations to regulate them in some countries and due to the existence of a legislative vacuum resulting from their lack of organization and identification of their procedures and the competent authority to adjudicate this type of issues.
