Abstract EN

This study addresses reasons for rejecting the annulment lawsuit in form, for causes related to the initiatory pleading before the administrative courts in the hashemite kingdom of Jordan, under the Jordanian administrative judiciary law, and compares it with the refusal of the annulment lawsuit in form under the Egyptian state council law.

then, the researcher attempted to get acquainted with all the reasons related to the dismissal of the case in form before the administrative courts, by deducing it from the provisions of the jordanian and egyptian administrative judiciary.

the researcher followed the descriptive and analytical approach by describing and explaining legal concepts and principles related to the dismissing of lawsuit for reasons related to the initiatory pleading in terms of formality.

among the most prominent conclusions and recommendations reached were : the need to enact legislation that regulates litigation procedures before the administrative court and the supreme administrative court; this is for the purposes of facilitating the judiciary, as well as activating the constructive and diligent role of the administrative judge in the annulment lawsuits, by dealing flexibly in his monitoring of the formal conditions related to accepting the annulment lawsuit.
