Abstract EN

The study dealt with the international and civil criminal responsibility of using non-conventional weapons prohibited by law for the devastating damage they cause.

this study aims to the international and civil criminal responsibility toward users of these weapons to take deterrent measures and inflict suitable sanctions on them.

moreover, the research adopted the descriptive analytical approach and, therefore, it came up with numerous results; most important of which are: that the rome statute of the international criminal court provided many penalties for the perpetrators of crimes, such as imprisonment, however, it did not provide the death penalty, which is considered one of the most severe deterrent penalties against anyone trying to use non-conventional weapons.

finally, the study proposes a number of recommendations, most important of which is that the researcher wishes for the international legislator to amend the text of article (8) related to war crimes in the rome statute of the international criminal court, by explicitly referring to the use of non-conventional weapons such as nuclear weapons, uranium, and chemical and biological weapons in armed conflicts.
